The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 467, 468, 471, 420, 409 and 120B of the Indian Penal Code. The prosecution case is that the informant contested the election for the post of Chairman of the Dhenuki PACS in the district of Saran but lost to the petitioner. Subsequently he came to know that the petitioner with the forged signature of the Chairman of the PACS fraudulently made several people the voter of the PACS.

It is submitted by learned counsel for the petitioner that since the petitioner lost the election at the hands

No.6273 of 2016 (2) dt.09-02-2016 2/2 of the petitioner and for the same cause of action Election Dispute Case No. 323 of 2014 has already been filed, hence, maliciously the present case has been lodged. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the nature of accusation, particularly, pendency of the election dispute case, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-IVth, Saran at Chapara in connection with Panapur P.S. Case No. 03 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
