JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-08-2019 This application, for grant of anticipatory bail, arises out of Sakra P.S. Case No. 569 of 2018, disclosing offences under Sections 147, 148, 149, 341, 323, 307, 427, 353, 504, 506 of the Indian Penal Code.

Prosecution case is that police raided the village of the petitioners on the information that a kidnapped girl was kept there and also recovered and arrested one accused person, thereafter, the petitioners and other accused persons came and attacked the police party and got the said accused freed and also caused injuries to the

Submission of learned counsel for the petitioners is that as a matter of fact that the girl is major and she has married with the co-accused of this case and she has also filed a peition before the court below stating that her father wanted to perform her marriage with some other person and due to which, she fled away. Further submission is that similarly situated co-accused persons have already been granted the privilege of anticipatory bail by a coordinate Bench of this Court vide order dated 23.05.2019 passed in Cr. Misc No. 33932 of 2019.

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioner, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate -IV, Muzaffarpur, in connection with Sakra P.S. Case No. 569 of 2018 subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
