Petitioner apprehends his arrest in C-III-30/2019, registered under Section 30(a) of the Bihar Prohibition and Excise Act.

According to the prosecution report, 17.260 litres of liquor was recovered behind the house of the petitioner and the same was covered with straw.

It is submitted that the recovery was made from an open place, of course at a some distance from the house of the petitioner but it cannot be said to be under the conscious possession of the petitioner. Anybody might have kept the same under straw. Petitioner has got no criminal antecedent. Considering the facts aforesaid, let petitioner, above
