JUSTICE DINESH KUMAR SINGH ORAL ORDER 08-02-2016 Heard learned counsel for the petitioners and the State. The petitioners being the parents and brother of the husband of the complainant are apprehending their arrest in a complainant case wherein processes have been directed to be issued after cognizance being taken for the offences punishable under Section 498A of the Indian Penal Code and under Sections 3/4 of the Dowry Prohibition Act.
The basic accusation is of torture for non-fulfillment of the dowry demand.
It is submitted by the learned counsel for the petitioners that the thrust accusation is against the husband of the complainant
Patna High Court Cr.Misc. No.6179 of 2016 (2) dt.08-02-2016 2/2 and the petitioners claim to be separate from the husband of the complainant.
Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned court below within a period of 12 weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Nawada in connection with Complaint Case No. 1967 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
