The petitioner has filed the instant application for grant of regular bail in connection with Arwal P.S. Case No. 78 of 2021 registered under section 379 of the Indian Penal Code. Prosecution case relates to theft of 48 pieces of battery worth Rs. 8 lakhs at Arwal-06, BIGT-14166 side Airtel, Motha by some unknown miscreants from a pick-up van, and it has been detected from the CCTV footage thereafter, the FIR has been registered against unknown.
Learned counsel for the petitioner submits that the petitioner is innocent and he committed no offence. Petitioner has falsely been implicated in this present case, only on the basis of his self confessional statement. It is further submitted
Patna High Court CR. MISC. No.38495 of 2022(3) dt.03-01-2023 2/2 that petitioner has no concern with seized articles and no recovery of stolen articles from his conscious possession. Petitioner is languishing in judicial custody since 24.05.2022. The application for bail is opposed by learned APP for the State.
Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, the Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with Arwal P.S. Case No. 78 of 2021 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Arwal.
