The petitioner seeks bail in Panjwara P.S. Case No. 51 of 2018, registered for the offence punishable under Sections 379, 411 and 34 of the Indian Penal Code.
As per the prosecution case, two FIR named and two unknown persons were stealing tyre from the vehicle of informant.
It is submitted on behalf of the petitioner that petitioner is not named in the FIR. During course of investigation, name of this petitioner has come in this case on the basis of confessional statement of co-accused Akash Yadav. No incriminating article has been recovered from possession of this petitioner. The informant has also not identified this petitioner. No test identification parade has been held till date.
Patna High Court CR. MISC. No.46754 of 2021(2) dt.17-11-2021 2/2 Petitioner claims clean antecedent and he is in custody since 24.05.2021. Investigation is complete.
Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate Ist, Banka in connection with Panjwara P.S. Case No. 51 of 2018.
