2. The petitioner apprehends arrest in a case registered for the offence punishable under sections 420, 467, 471, 120B of the Indian Penal Code.

3. As per the prosecution case, petitioner was appointed as block teacher on the basis of forged and fabricated educational certificate.

4. Learned counsel appearing for the petitioner refers to paragraph 14 of the counter affidavit filed by the Vigilance Department wherein it has been stated that the S.P., Vigilance Investigation Bureau, Patna vide letter no.-7386 dated 12.06.2024 has informed S.P., Kishanganj that Madhyama marks sheet and certificate submitted by the accused petitioner

Patna High Court CR. MISC. No.41476 of 2024(4) dt.24-09-2024 2/2 Niva Kumari @ Nibha Kumari as per verification report of Bihar Sanskrit Shiksha Board, Patna letter no. 2296R dated 07.06.2024 is correct. ( annexure OP/E).

5. Learned counsel for the other side does not controvert this fact.

6. Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within eight weeks from today, let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Kishanganj in Kochadhaman Police Station Case No. 234 of 2023, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
