JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 26-11-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner happens to be mother in law of the deceased and is languishing in jail custody since 01.08.2015 in a case registered for the offences punishable under Sections 304B/34 of the Indian Penal Code.

Although, there is allegation of illegal demand and torturing against the petitioner but it appears that except injury on the neck of the deceased, there was no any other injury on the person of the deceased.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on

Patna High Court Cr.Misc.
