The petitioner has filed the instant application for anticipatory bail apprehending his arrest in connection with Khutauna P.S. Case No. 122 of 2018 registered for the offences under Sections 304(B)/34 of the Indian Penal Code. At the outset it is submitted by learned counsel for the petitioner that the case of the petitioner stands on a better footing than the father-in-law and mother-in-law of the deceased who have both been granted anticipatory bail by order dated 25.04.2019 passed in Cr. Misc. No. 27185 of 2019. The petitioner in the instant case happens to be the cousin brother of the husband of the deceased.
Having heard the learned counsel for the petitioner and
Patna High Court CR. MISC. No.34935 of 2019(2) dt.30-05-2019 2/2 the learned APP for the State, in view of the facts and circumstances stated herein above, I am inclined to enlarge the petitioner on bail. Let the petitioner namely, Pawan Yadav surrender in the Court below within six weeks from today. In case of his arrest or surrender, the petitioner is directed to be enlarged on bail on furnishing bail bond of Rs 10,000.- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate III, Jhanjharpur, Madhubani in connection with Khutauna P.S. Case No. 122 of 2018 subject to the conditions as laid down in Section 438 (2) of Criminal Procedure Code.
