Paragraph No. 10 of the counter affidavit reads as follows:- "10. That if the petitioner is not satisfied with the nature of the land being agricultural then they may file application before the competent court i.e. the Arbitratorcum-Commissioner, Patna Division with regard to the reconsideration of the nature of the land. The petitioner has directly approached the Hon'ble Court which is not tenable in the eyes of law."

In view of the above, this application is disposed of with a direction to the petitioner to approach the Land Acquisition and Rehabilitation Authority, Patna, for reconsideration of his grievances about the nature of land. However, if the same is filed before the Arbitrator, it shall be disposed of within a period of eight weeks in accordance with law.

The petitioner is permitted to receive the award

Patna High Court CWJC No.9630 of 2022(3) dt.08-08-2022 2/2 amount under protest, it will not affect the right of the petitioner to move the authority for change of nature of land. (Sandeep Kumar, J) Saif/- U
