NILU AGRAWAL ORAL ORDER 17-02-2016 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

Petitioners seek modification of the order dated 17.12.2015 passed in Cr. Misc. No. 52043 of 2015. It has been submitted in paragraph 5 of this application that petitioner no.2, who is son of petitioner no.1 and petitioner no.3, who is relative of petitioner nos. 1 and 2, have not fulfilled the directions to surrender before the court of learned SDJM, Hajipur in connection with Goraul P.S. Case No. 188 of 2015 within the stipulated period as specified in the order for the reason that petitioner no.2 suddenly fell ill. Hence, prayer is to extend the period of surrender by further eight weeks.

Patna High Court Cr.Misc. No.6991 of 2016 (2) dt.17-02-2016 2/2 Be that as it may, let the time of surrender granted under order dated 17.12.2015 passed in Cr. Misc. No. 52043 of 2015 be extended by further eight weeks from today and the said order is modified to the extent indicated above. This modification application is, accordingly, allowed.
