JUSTICE DINESH KUMAR SINGH ORAL ORDER 14-12-2015 Heard learned counsels for the petitioner and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 147, 341, 323, 379, 307, 324 and 504 of the Indian Penal Code. The prosecution case is that petitioner no.1 caused injury with knife on the head of the informant and when he fell down other accused persons including petitioner nos. 2 and 3 made assault. It is also alleged that petitioner took out `6,500/- from the pocket of the informant.
It is submitted by learned counsel for the petitioners that the injury of the informant has been found to be simple superficial in nature caused by hard and blunt substance where it is
Patna High Court Cr.Misc. No.56488 of 2015 (2) dt.14-12-2015 2/2 specifically alleged that petitioner no.1 caused injury with knife. There is counter version of the occurrence also. A statement has been made in para 3 of the petition that the petitioners have no criminal antecedent.
Considering the accusation not corroborated by the medical opinion, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Saran at Chapra in connection with Rasulpur P.S. Case No. 92 of 2013, subject to the conditions as laid down under Section 438(2) Cr.P.C.
