JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 26-02-2016 Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State. This application, for grant of anticipatory bail, arises out of Bettiah Town Police Station Case No. 779 of 2015, disclosing offences under Sections 394 and 395 of the Indian Penal Code and Section 27 of the Arms Act. Learned Counsel for the petitioner submits that he was not named in the First Information Report and his name has surfaced only on the basis of confessional statement of the co-accused, who was apprehended on the spot.
Considering the nature of the offences, I am not inclined to grant the petitioner privilege of anticipatory bail.

The petitioner, Nandlal Prasad, is directed to surrender before the Court below within a period of four weeks from today and seek regular bail, if so advised. If he does so, his application for regular bail shall be considered by the learned Court below on its own merit without being prejudiced by rejection of present application for grant of anticipatory bail.
