The petitioner has preferred this application for grant of regular bail in connection with Dharhara P.S. Case No. 15 of 2023 dated 20.01.2023 registered for the offences punishable u/s 341, 323, 324, 307 read with Section 34 of the Indian Penal Code. As per the prosecution case, when the informant was returning from the market, the petitioner and the co-accused persons attacked him with knives. The petitioner inflicted blows of knife on the head of the informant with intent to kill causing head injury. The co-accused Ankit Singh and Gulab Singh attacked on his chest with butt of pistol indiscriminately causing broken

Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from the conscious possession of the petitioner. The petitioner has got clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 05.04.2023. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner. As per injury report of the injured, the injury no. 1 and 3 are simple in nature and the injury no. 2 is grievous in nature. The injured sustained soft swelling in frontal region which is simple in nature.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner above-named, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Munger in connection with Dharhara P.S. Case No. 15 of 2023. The application stands allowed.
