01-12-2015 Heard Sri Sanjay Kumar Pandey No. 5, learned counsel, who was assisted by Sri Subash Kumar, learned counsel for the petitioner and learned Addl. Public Prosecutor. The petitioner, who is in custody since 22-05-2015 in Sasaram Rail P.S. Case No. 41 of 2014 registered for the offence under Section 414 of the Indian Penal Code, sections 25(1-b)a, 26 of the Arms Act, 1959 and section 13 of the Foreign Exchange Regulation Act, 1999, has prayed for grant of bail. Learned counsel for the petitioner submits that in the case, it was alleged that two cartridges of 315 Bore was recovered from the possession of the petitioner and besides this, two currency note of one Riyal (Saudi Arabia currency) was recovered from his possession. The petitioner is in custody since May, 2015.

Keeping in view the period of custody and nature of allegation, let the petitioner namely Shahbaz Alam @ Sahrukh Khan be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Railway Magistrate, Gaya/concerned court in connection with Sasaram Rail P.S. Case No. 41 of 2015.
