The petitioner seeks bail in connection with Jankinagar P. S. Case No.128 of 2021, instituted for the offences under Sections 272, 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act. The learned counsel for the petitioner submits that the petitioner is in custody since 30.06.2021, he is a person with clean antecedent and charge-sheet has been submitted in this case.

Allegation is of recovery of 201 litre of liquor from a tempo.

The learned counsel for the petitioner submits that petitioner is not the owner of the tempo rather he is the driver

Patna High Court CR. MISC. No.45994 of 2021(2) dt.10-12-2021 2/2 and some passenger had left the aforesaid liquor in the tempo of which the petitioner was not aware.

Learned A.P.P. opposes the bail application.

Considering the fact that the petitioner is in custody since 30.06.2021, he is a person with clean antecedent and charge-sheet has been submitted in this case, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of learned Special Excise Judge, Purnea in connection with Jankinagar P. S. Case No.128 of 2021.

The application stands allowed.
