ANJANA MISHRA ORAL ORDER 23-05-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is apprehending his arrest in connection with Mokama P.S. Case No.37 of 2019 for allegedly having committed the offence under Section 7 of the Essential Commodities Act.

Learned counsel for the petitioner submits that the alleged recoveries were made from the other person who has taken the name of the present petitioner. Learned counsel further submits that since the recovery was not made from the possession of the petitioner, he may be extended the privilege of pr-arrest bail.

Considering the aforementioned facts and circumstances and that there is no criminal antecedent against

No.34066 of 2019(2) dt.23-05-2019 2/2 the petitioner, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Barh at Patna, in connection with Mokama P.S. Case No.37 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
