Petitioner seeks bail in Pachrukhi (Sarai) P.S. Case No.16 of 2019 instituted for the offence under Section(s) 302, 120-B/34 Indian Penal Code and Section 27 of the Arms Act. Counsel for the petitioner submits that there is no eye witness to the occurrence.
It is alleged that this petitioner along with four named and three unknown persons took brother of the informant. Later on, his dead body was found.
Counsel for the petitioner submits that seven cartridges were recovered from possession of the deceased, which will be apparent from the Annexure- 2. It is submitted
Patna High Court CR. MISC. No.42891 of 2019(2) dt.17-07-2019 2/2 that allegation against petitioner is of only last seen with the deceased.
Petitioner is in custody since 15.01.2019.
In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, VI, Siwan, in connection with Pachrukhi (Sarai) P.S.
