The petitioner has preferred this application for grant of regular bail in a case registered under section 394 of the Indian Penal Code.

As per the prosecution case, three accused persons are stated to have fired upon the informant causing gunshot injuries. It is further submitted that they took away Rs.2 lacs in cash as also the motorcycle and other articles of the informant as mentioned in the F.I.R.

It is submitted by learned counsel for the petitioner that the F.I.R. was registered against unknown. In course of investigation the name of the petitioner transpired along with other accused persons in the statement of the spy recorded in paragraph no. 27 of the case diary and thereafter in the

Patna High Court CR. MISC. No.46508 of 2021(3) dt.03-03-2022 2/2 confessional statement of coaccused Ashok Mahto recorded in paragraph no. 53 of the case diary. The petitioner has not been put on T.I. parade. No incriminating article has been recovered from his possession. He is in custody since 3.12.2020 and has no criminal antecedent. Chargesheet has been submitted in the case.

Having heard learned counsel for the parties and taking into consideration the facts of the case together with the petitioner not having any criminal antecedent and having remained in custody for over 1 year 3 months, the Court directs the petitioner to be enlarged on bail in connection with Sohail P.S. Case no. 07 of 2020 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Sherghati, Gaya.
