2. The petitioner seeks regular bail in connection with Singhiya P.S. Case No.6 of 2025, registered for the offences punishable under Sections 126(2), 115(2), 223, 336(3), 338, 303(2), 352, 351(2) and 3(5) of the Bharatiya Nyaya Sanhita.
3. As per the prosecution case, on the alleged date and time of occurrence, while informant along with his family members was doing construction work on his land in the meantime, all the FIR named accused persons including this petitioner came with deadly weapons and started assaulting them. It is alleged that co-accused Angad Yadav and Ravindra Yadav assaulted uncle of the informant by means of iron rod due

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. Further submission is that there is land dispute between the informant and co-accused Jitan Sada and Amarjeet Sada and petitioner has no concern with the land in question or any of the parties. Petitioner was neither present on the place of occurrence nor he has participated in the alleged occurrence. It is also submitted that the First Information Report has been lodged after a delay of five days without any plausible explanation. There is no specific overt act alleged against the petitioner. Petitioner is in custody since 21.03.2025 and the charge sheet has already been submitted in this case. Petitioner has got three criminal antecedents in which he is on bail. Petitioner undertakes to cooperate in framing of charge and trial.
5. Learned counsel for the informant and learned A.P.P. for the State has opposed the prayer for regular bail of the petitioner.
6. Considering the facts and circumstances of the case and the submissions of learned counsel for the parties, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of
Patna High Court CR. MISC. No.35199 of 2025(3) dt.06-08-2025 3/3 the like amount each to the satisfaction of learned Judicial Magistrate-I, Rosera at Samastipur in connection with Singhiya P.S. Case No.6 of 2025.
