JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 05-02-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with L.N.M.U. P.S. Case No. 234 of 2015 registered under Sections 376, 323 and 504 of the Indian Penal Code.

The accusation is that petitioner developed the physical relation with the informant on December, 2012, forcibly. Thereafter, on pretext of performing the marriage, petitioner continued the physical relation with the informant but on 20.07.2015 petitioner refused to perform the marriage with the informant. Thereafter, the Panchayat was arranged on 27.07.2015, in which, father of petitioner also refused to perform the marriage of the petitioner with the informant.

Patna High Court Cr.Misc. No.51114 of 2015 (3) dt.05-02-2016 Learned counsel for the petitioner submits that petitioner has falsely been implicated due to land dispute moreover, the age of the victim has been assessed as 19 to 20 years. It is further submitted that petitioner has no criminal antecedent and is in custody since 07.09.2015. Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Darbhanga, in connection with L.N.M.U.
