The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 307, 341, 323, 324, 379, 448, 504, 34 of the Indian Penal Code.
The prosecution case as per F.I.R is that when the informant was sitting at his door, all the F.I.R named accused persons including the petitioner came and started abusing and when the informant made protest, co-accused Shiya Sharan Thakur and Tribhuwan Thakur caught him and petitioner Vinod Thakur and Ajit Kumar
Patna High Court CR. MISC. No.37128 of 2022(2) dt.30-11-2022 2/3 Singh inflicted knife blow upon the informant causing injuries to him.
It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in this case and in the background of some previous dispute, the present F.I.R has been registered. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Learned counsel appearing on behalf of the informant and learned A.P.P appearing on behalf of the State has vehemently opposed the prayer for anticipatory bail of the petitioner and submitted that there is direct allegation against the petitioner that he inflicted knife upon the informant. The injury report of the informant which has been annexed as Annexure-2 shows eight incised wound and the doctor has opined the injuries to be grievous in nature caused by sharp cutting weapons.
In the facts and circumstance of the case, this

The prayer for grant of anticipatory bail to the petitioner stands rejected.
The petitioner is directed to surrender before learned Court below and pray for regular bail. The learned Court below may consider the prayer for regular bail of the petitioner without being prejudiced by the order of this Court.
