Petitioner is accused in connection with Kudra P.S. Case No. 52 of 2015 registered under Sections 409 and 420 of the I.P.C.

The accusation is that the petitioner, as per agreement with the Bihar State Food Corporation, lifted 15300 quintals of paddy for milling the rice and he had to return 10251 quintals of rice, but he did not return 9775 quintal of rice and thereby the petitioner committed breach of trust of Rs. 2,27,40,911.93.

Learned counsel appearing on behalf of the petitioner submits that certificate case is pending in between the petitioner

Patna High Court Cr.Misc. No.51419 of 2015 (2) dt.21-12-2015 2/2 and Bihar State Food Corporation for realization of the amount, as detailed in the F.I.R. It is also submitted that petitioner is in custody since 26.09.2015.

Having considered the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Kaimur at Bhabhua in connection with Kudra P.S. Case No.52 of 2015.
