====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 27-05-2019 Heard learned counsel for the petitioners as well as learned counsel for the State.

Petitioners apprehend arrest in a case registered for the offences punishable under Sections 341, 342, 323, 354(B) / 504/506/34 of the I.P.C.

Prosecution case, in short, is that the petitioners assaulted the victim by legs and fists.

Learned counsel for the petitioners submits that the injury sustained by the victim (Annexure-2) were simple in nature. Petitioners are having no criminal antecedent. Admittedly, there is land dispute between the parties. Considering the facts of the case, let the petitioners, above named, in the event of their arrest/surrender before the

No.34173 of 2019(2) dt.27-05-2019 2/2 Court below within a period of six weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the C.J.M., Bhagalpur in Kahalgaon P.S. Case No. 510 of 2017, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioners shall fully cooperate with the investigation and trial of the case, failing which the Court below shall be at liberty to cancel the bail bond of the petitioners.
