JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 22-02-2016 Heard the learned counsel for the petitioner as well as the learned A.P.P for the State.

The petitioner seeks bail in a case for the offences punishable under sections 147, 148, 149, 341, 342, 302, 452 and 380/120 (B) of the I.P.C Allegedly, the petitioner, other five FIR named accused persons and some unknown came and took away Rajendra Paswan, the husband of the informant and thereafter he was shot dead and her dead body was recovered with fire arm injury. Submission is of false implication and that the informant is not an eye witness, only she has seen the petitioner and others taking away her husband, she has not heard the sound of firing rather after search she found the dead body of her

Patna High Court Cr.Misc. No.51268 of 2015 (4) dt.22-02-2016 2/2 husband, admittedly the deceased was a criminal and involved in fifteen cases, he might have been killed by his other enemies and the petitioner has been made the victim of the circumstances. The learned A.P.P. opposes prayer for bail by submitting that the petitioner has got criminal antecedent. In the facts and circumstances as stated above, considering the allegation and the criminal antecedent of the petitioner, at present this Court is not inclined to enlarge the petitioner on bail and accordingly his such prayer stands rejected in connection with Dehri (T) P.S. Case No. 249 of 2015 pending in the court of S.D.J.M. Dehri-On-Sone, Rohtas. (Jitendra Mohan Sharma, J) Abhay/- U T
