The petitioner is languishing in custody since 19.3.2019 in a case registered for the offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. On a specific information about trafficking of illicit liquor, raid was laid and 27.700 litres of illicit liquor was recovered. It is submitted by learned counsel for the petitioner that the recovery not being made from motorcycle, hence it cannot be treated from the conscious physical possession of the petitioner. Statement has been made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent.

Learned APP submits that there is accusation of recovery of illicit liquor.

Considering the nature of recovery and the period
