The petitioner has preferred this application for grant of regular bail in a case registered under sections 304B and 34 of the Indian Penal Code.

As per the prosecution case, the daughter of the informant was married to the son of the petitioner. It is stated that all the accused persons named in the FIR including the petitioner herein physically and mentally tortured the daughter of the informant and she was ultimately killed. It is further stated that without giving any information she was taken to Panchsheel Hospital in Kankerbagh where she died.

It is submitted by learned counsel for the petitioner that the petitioner who happens to be the father-in-law of the deceased

Patna High Court CR. MISC. No.46798 of 2021(4) dt.08-03-2022 2/2 has been falsely implicated in the case. Both the daughter of the informant and son of the petitioner herein attempted jointly to commit suicide, however, while the son of the petitioner was saved, the daughter of the informant succumbed. Both of them were taken by the petitioner to the hospital. The husband of the deceased has been granted bail vide order dated 16.7.2021 passed in Cr. Misc. no. 32593 of 2021. The petitioner is in custody since 6.6.2021 and has no criminal antecedent.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, the petitioner being in custody for 9 months and investigation in the case having concluded, the petitioner is directed to be enlarged on bail in connection with Hajipur Town P.S. Case no. 743 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur.
