However, learned counsel for the petitioner is present. The present application has been filed for cancellation of anticipatory bail granted to Opposite Party No.2, vide order dated 15.11.2016 passed in Criminal Miscellaneous No. 27389 of 2016 in connection with Complaint Case No.544 C of 2013, pending before the learned CJM, Lakhisarai.

The Opposite Party No.2, being the husband of the petitioner, was granted anticipatory bail on agreement to make payment of one time settlement amount of Rs.12,00,000/-. It is submitted by learned counsel for the petitioner that since the entire amount has already been paid by Opposite Party No.2, hence, she is not inclined to press the prayer for cancellation of bail of Opposite Party No.2. But out of total

Patna High Court CR. MISC. No.34188 of 2017(13) dt.04-03-2020 2/2 amount of Rs.12,00,000/-, Rs.1,00,000/- has been deposited in cash before the learned Court below. Hence, the said amount may be released in favour of the petitioner.

In the circumstances, the petitioner is at liberty to file an appropriate application before the learned Court below who will pass appropriate order for release of the said deposited amount in favour of the petitioner.

Accordingly, the present application stands disposed of as not pressed.
