2. The petitioner is apprehending his arrest in connection with Rafiganj P.S. Case No. 653 of 2024 for the offence under sections 77, 78, 79, 64(i), 356(ii) and 351(ii) of the Bhartiya Nyaya Sanhita, Section 4 of the POCSO Act and Section 66(e) of the I.T. Act lodged on 08.11.2024 by the informant, Rinku Kumari.
3. As per the prosecution story, the informant alleged that being a student of a local college, she used to stay with her elder married sister. The petitioner who is related to the informant's brother-in-law, earlier when she was minor, made physical relationship and upon protest, threatened her of dire
Patna High Court CR. MISC. No.35528 of 2025(3) dt.16-09-2025 2/2 consequences. The allegation is that her pictures were also taken by him and subsequently, the allegation is that her nude photographs were circulated through whatsapp to all her family members. This led to the FIR.
4. Learned counsel for the petitioner submits that they were in relationship and only to malign him, the allegation.
5. Learned counsel for the informant on the other hand submits that not only, at that time, she was minor, the specific phone numbers have been given on which the photographs were made viral. The last submission is that despite having criminal antecedent, in paragraph-3 it has been recorded that the petitioner is a man of clean antecedent.
6. Considering the allegation that has come against the petitioner specially of making her nude photographs viral on the phone numbers of her family members coupled with the fact that he has criminal antecedent but the same has been suppressed in paragraph-3, no relief can be granted.
7. The anticipatory bail application stands rejected. (Rajiv Roy, J) Adnan/- U T
