The petitioners are languishing in custody since 11.03.2019 in a case registered for the offence punishable under Section 379 of the Indian Penal Code.

It is alleged that on the motorcycle of the informant and his neighbour were got stolen, leading to registration of the FIR against unknown. During investigation, one Dhirendra Sahni was apprehended, who in his confession disclosed the name of the petitioners.

It is submitted by learned counsel for the petitioner s that there is no recovery from possession of the petitioners and

Patna High Court CR. MISC. No.35195 of 2019(2) dt.29-05-2019 2/2 co-accused Dhirendra Sahni, on whose confession the name of the petitioners sprang up, has been granted bail by a Co-ordinate Bench of this Court vide order dated 13.05.2019 passed in Cr. Misc. No. 31719 of 2019. A statement has been made in paragraph 3 of the petition that the petitioners are accused in one another case in which they are on bail.

Learned APP submits that the name of the petitioners sprang up during investigation.

Considering the nature of accusation, there is no recovery from the petitioners and investigation being concluded, let the above named petitioners be released on bail, on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned S.D.J.M. 5th, Dhaka at Motihari in connection with Dhaka P.S. Case No. 395 of 2018.
