The petitioner seeks bail in connection with Sikraul P.S. Case No. 5 of 2015 registered for the offence punishable under Section 302 of the Indian Penal Code.
Allegedly, the petitioner being the step-father of Puja Kumari, threw her in fire and when the informant tried to rescue her daughter, she was pushed back and then the petitioner threw Puja Kumari on the earth causing her death.
Submission is of false implication and that the informant only with a view to harass the petitioner lodged this case, as a matter of fact the deceased died in accidental fire and
Patna High Court Cr.Misc. No.53376 of 2015 (3) dt.18-01-2016 2/2 under mis-conception the informant lodged this case resulting he is suffering in custody since 17.01.2015, having no criminal antecedent, to which the learned A.P.P. opposes. In the facts and circumstances stated above, considering the allegation attributed against the petitioner, serious and heinous in nature, this court is not inclined to enlarge the petitioner on bail and accordingly his such prayer for bail stands rejected.
