JUSTICE SUDHIR SINGH ORAL ORDER 12-04-2016 Heard learned counsel for the petitioner, learned counsel for the Informant and learned counsel for the State. The petitioner is apprehending his arrest in connection with Sasaram Nagar P.S. Case No. 1403 of 2015 for the offences instituted under Sections 342, 354, 354A, 354D, 366, 511, 385 and 341 of the Indian Penal Code.

As per prosecution case one Madan Mohan Pandey has given a written application to the SHO, Sasaram Nagar police station stating therein that on 09.12.2015 his daughter Sneha Pandey, who is student of B.Sc. Part-II Shankar College Sasaram and she had gone to S.P.Jain College, Sasaram for her examination and after completion of examination informant along

his daughter Sneha Pandey while returning to his house intercepted by petitioner along with 8-10 associates and they were trying to pull his daughter forcibly and on protest by the informant and his father they assaulted them by fists and slaps and abused them thereafter informant lodged a complaint to the college administration and it is also alleged by the informant that petitioner is trying to forcibly oust to informant from his house and threatened him to pay rangdari tax of Rs.5,00,000/- otherwise he will be killed and his prestige will be ruined. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. From perusal of Annexure-2, it is evident that a Sanha was filed in the court of the Chief Judicial Magistrate, Rohtas at Sasaram dated 31.01.

2015 stating by the father alleging that the informant forcibly wants the petitioner to get married to his younger daughter. After much belated stage on 11.12.2015 FIR was instituted by the informant with the aforesaid allegations. From perusal of Annexure-3, it is evident that the daughter of the informant and the petitioner were in love affair which was objected by the father of the petitioner and the informant in retaliation to the same has instituted the present FIR.

Informant, it has been submitted that the petitioner is named in the F.I.R. and he had been misbehaving with the daughter of the informant from before.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail in the event of his arrest or surrender before the learned court below within a period of six weeks from today in connection with Sasaram Nagar P.S. Case No. 1403 of 2015/G.R.No.2861 of 2015 on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Sasaram, District-Rohtas, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
