The petitioners seek bail in connection with Gobindganj P.S. Case No. 182 of 2015 registered under Section 302 & 201 read with 34 of the Indian Penal Code. It has been contended that the deceased was an old lady and she died a natural death. The petitioner no. 1 is the husband of the deceased whereas petitioner no. 2 is the elder brother of the son-in-law of the deceased who resides in the
Patna High Court Cr.Misc. No.52787 of 2015 (3) dt.30-01-2016 2 / 2 same village and there is no specific allegation against him. On the other hand, learned counsel for the State has contended that the body of the deceased was found from an open field and in postmortem examination, the doctor has opined the cause of death to be asphyxia due to throttling. Regard being had to the facts and circumstances of the case, I am not inclined to grant bail to the petitioner No. 1, Singasan Ram, who is husband of the deceased. Accordingly, his application for bail is rejected.
So far as petitioner No. 2, Jhunjhun Ram is concerned, he is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Motihari, East Champaran in connection with Gobindganj P.S. Case No. 182 of 2015.
