Learned counsel for the Railways is present and submits that he has no objection if the petitioners are seeking their remedy under the terms of the contract. In the given facts and circumstances of the case, this writ application is being disposed of without going into the merit of the case granting liberty to the petitioners to seek their remedy under the terms of the contract.
