The petitioners seek bail in connection with Bath P.S. Case No. 120 of 2024 instituted for the offence under Sections 406, 420, 467, 468, 471 & 34 of the Indian Penal Code. 3.

As per the prosecution case, FIR has been lodged against four named accused persons with the allegation that the seller fraudulently sold the informant's land to four buyers by a common sale deed No. 5469, by which the vendor sold the land.

It has been submitted on behalf of the petitioners that the petitioners are in custody since 26.02.2025 and have one criminal antecedent each, as per disclosure made in paragraph No. 3 of the bail application.

It has been further submitted by the petitioners' counsel that petitioners have been falsely implicated in the present case. There is no any specific allegation against the petitioners. Petitioners had purchased the land from Sadanand Prasad Verma on his assurance after paying consideration money to him, who is co-sharer of the land with the informant. Learned counsel further submits that petitioners being the purchaser are also the victims in this case. Similarly situated coaccused has been granted anticipatory bail by a Co-ordinate Bench of this Court vide order dated 23-07-2025, passed in Cr. Misc. No. 31354 of 2025.

Learned A.P.P. for the State and learned counsel for O.P. No. 2 vehemently opposed the prayer for grant of bail to the petitioners. Charge sheet has already been submitted in this case.

Considering the aforesaid facts and circumstances

Patna High Court CR. MISC. No.40148 of 2025(5) dt.09-10-2025 3/3 of the case, period of custody of the petitioners, claim based on parity and charge sheet being submitted, this Court is inclined to grant bail to the petitioners.

Let the petitioners be released on bail on furnishing bail bonds of Rs. 15,000/- (Fifteen Thousand) each with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Bath P.S. Case No. 120 of 2024.
