JUSTICE DINESH KUMAR SINGH ORAL ORDER 11-02-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 504 and 506 of the Indian Penal Code and Section 3 (I) (II) (X) of the SC/ST (Prevention of Atrocities) Act.

It is alleged that the petitioner threw mud from the drainage in the house of the informant and also abused by calling caste name.

It is submitted by learned counsel for the petitioner that for the occurrence of 10.05.2015 at 11.10 PM the FIR was lodged on 11.05.2015 at 1.30 PM. For flowing drainage water in front of the house of the petitioner, some scuffle took place when the case was lodged. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent.

Patna High Court Cr.Misc. No.6524 of 2016 (2) dt.11-02-2016 2/2 Learned Special Public Prosecutor submits that on conclusion of investigation, the final form was submitted and petitioner has been chargesheeted.

Considering the genuineness of the occurrence, it is a case for consideration of regular bail.

The aforesaid facts constitute good ground for consideration of prayer for regular bail.

Let the learned court below consider the prayer for regular bail of the petitioner if he surrenders within a period of six weeks in connection with Nawada SC/ST P.S. Case No. 34 of 2015 pending in the court of learned ACJM-V, Nawada. Accordingly, the application is disposed of.
