2. The petitioner is apprehending his arrest connection with Vaishali Complaint Case No. 943 of 2019, dated 08.04.2019 registered for the offences punishable under Sections 420, 406 of the Indian Penal Code and Section 138 of Negotiable Instrument Act..
3. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case. He
Patna High Court CR. MISC. No.42336 of 2024(2) dt.24-07-2024 2/2 further submits that the allegation as alleged in the F.I.R. is false and fabricated and the petitioner has not committed any offence as alleged in the F.I.R.

Learned counsel for the Informant as well as learned APP for the State, on the other hand, opposed the prayer for anticipatory bail of the petitioner and learned counsel for the Informant submits that in view of the fact that the process under Section 82 & 83 of the Cr. P.C. has been issued by the learned Court below and also relied upon a judgment passed in Special Leave Petition (Crl.) No. 7940 of 2023 (Srikant Upadhyay & Ors. Vs. State of Bihar & Anr.) which was passed on 14.03.2024 and hence, the present bail petition is not maintainable.
5. In view of the aforesaid, the application stands dismissed as not maintainable.
