Ajay Singh, the brother of deceased Vijay Singh filed written report disclosing therein that while his brother Vijay Singh reached near his sasural, his brother-in-law Deepak Kumar Singh, mother-in-law Ranjana Devi and wife Bharti Devi assaulted and during course thereof, Deepak Kumar Singh gave Garassa blow over left leg, which ultimately proved fatal. From perusal of the case diary, it appears that none has named the petitioner however, from para-49 it is apparent that his name cropped up in supervision note of Deputy Superintendent of Police, Katihar whereupon he has been added as an accused.

That being so, the petitioner Bedanand Singh is directed to be released on bail on furnishing bail bond of Rs.10,000/- with
