JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 07-11-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case registered for the offence punishable under Section 7 of E.C. Act, 1955. As per prosecution case, a truck was found loaded with 408 bags of rice, standing near the house of the petitioner, for black marketing.
Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. It is submitted that petitioner is an agriculturist and not a P.D.S dealer. The seized rice is grown on his own land and not purchased illegally from any P.D.S dealer. Petitioner has got clean antecedent.

No.37013 of 2022(2) dt.07-11-2022 2/2 Considering the aforesaid facts and circumstances, let the above named petitioner in the event of his arrest/surrender before the court below within a period of thirty days from the date of receipt/production of copy of this order, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Purnea in Dagarua P. S. Case No. 59 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
