JUSTICE DINESH KUMAR SINGH ORAL ORDER 16-02-2016 Petitioners being parents and brother of the husband of the victim are apprehending their arrest in a case registered for the offences punishable under Sections 304(B)/201/34 of the Indian Penal Code.
The basic accusation is killing the granddaughter of the informant after two years of marriage for nonfulfilment of dowry demand. It is submitted by learned counsel for the petitioners that victim received accidental burn injury and she was first taken to the Sadar Hospital and thereafter S.K.M.C.H, Muzaffarpur. Petitioner No. 2 is cancer patient and at the relevant date she was admitted in Safdargunj Hospital, New Delhi, whereas petitioner Nos. 1 and 3 were also present at Delhi as attendant of petitioner No. 2. Patna High Court Cr.Misc. No.6955 of 2016 (2) dt.16-02-2016 2/2 is against the husband of the victim. It is further submitted that petitioners claim to be separate from the husband of the victim.
Considering the thrust of accusation against the husband of the victim, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi in connection with Sitamarhi P.S. Case No. 671 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
