The petitioner is apprehending his arrest in a case registered for the offence punishable under Section 414 of the Indian Penal Code.

Allegation against the petitioner is that he is dealing for sale and purchase of theft motorcycle.

Learned counsel for the petitioner submits that there is no recovery from the possession of the petitioner and has clean antecedent. Petitioner was neither arrested on the spot nor any incriminating articles has been recovered from his possession. Rather his name is disclosed by the co-accused in the confessional statement.

In the aforesaid facts and circumstances of the case,

Patna High Court CR. MISC. No. 35830 of 2019(4) dt.13-08-2019 2/2 let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt of the order, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Hasanpur P.S. Case No. 51 of 2019 to the satisfaction of the learned A.C.J.M.-III, Rosera, Samastipur, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
