A counter affidavit has been filed on behalf of the respondent no. 6.
The petitioner after serving the State Government in the Department of Agriculture as Village Level Worker (VLW) retired on 30.11.1999. Indisputably, all retrial dues are authorized/paid to him. The present writ application seeks a direction upon the respondents to revise the pension of the petitioner upon grant of benefits under Assured Career Progression (ACP) scheme implemented by the State Government.
Patna High Court CWJC No.10028 of 2014 dt.05-02-2016 2/2 In the counter affidavit of the Accountant General, it has been stated that a request in this regard was made by the office of Accountant General to the Block Development Officer (BDO), Karpi Arwal. Upon receipt of a communication dated. 29.01.2015 granting benefits under the ACP scheme, the pension has already revised. In support of the said contention, Annexure-A series have been enclosed.
Having heard the parties, it appears that the grievance of the petitioner has been redressed. The application stands disposed of as having become infructuous. Needless to observe that if the petitioner has any grievance with respect to the calculation of the dues, he may approach the appropriate/Competent Authority ventilating the said grievance.
