SONI SHRIVASTAVA ORAL ORDER 16-07-2025 As both the cases arise out of the same police station case number, with consent of parties, they have been heard together for final disposal at this stage itself.
2. Heard learned counsel for the petitioners, learned counsel for the informant and learned A.P.P. for the State.
3. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 126 (2),
Patna High Court CR. MISC. No.35165 of 2025(4) dt.16-07-2025 2/3 115 (2), 118 (1), 109 (1), 303 (2), 352, 351 (1) and 3 (5) of the B.N.S., 2023.
4. The allegation in the first information report is that the accused persons including these petitioners assaulted the informant by means of rod and stick.
5. It is submitted by learned counsel for the petitioners that there is general and omnibus allegations of assault against all the accused persons due to previous enmity. Further, there is case and counter case and the persons from the petitioners' side have also sustained injury in the said occurrence. Annexure-P/2 is the injury report and Annexure-P/3 is the first information report filed by the petitioner, Absar Karim @ Afsar Karim @ Afsar Khan of Cr. Misc. No.35165 of 2025.
6. Learned APP for the State and learned counsel for the informant opposed the grant of anticipatory bail on account of the fact that the injury report of the informant indicates that he has suffered grievous injury.
7. Taking into consideration the facts and circumstances of the case as well as the fact that there is case and counter case and the petitioner, Absar Karim @ Afsar Karim @ Afsar Khan has also sustained grievous injury, let the above named petitioners, be released on bail, in the event of their arrest or

No.35165 of 2025(4) dt.16-07-2025 3/3 surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned lower Court where the case is pending/successor Court in connection with Aurangabad Town P.S. Case No.22 of 2025, subject to the condition as laid down under Section 482 (2) Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023.
