2. Learned counsel for the petitioner submits that bail application of the petitioner in connection with N.D.P.S. Case No. 113 of 2022 arising out of Aurai P.S. Case No. 57 of 2022, dated 17.03.2022 has earlier been rejected vide order dated 02.11.2022 passed in Cr. Misc. No. 42201 of 2022 in which liberty was granted to the petitioner that he may renew his prayer for bail, 6 months after framing of charge.

3. Learned counsel for the petitioner further submits that charge has been framed in this case on 08.08.2022 and 6 months has already been lapsed.

4. Learned A.P.P. for the State opposes the prayer for bail and submits that at the time of considering the bail

Patna High Court CR. MISC. No.37157 of 2023(3) dt.02-08-2023 2/2 application, progress report called for from the Trial Court may be taken into consideration.

5. Upon going through the progress report, it transpires that it has been acknowledged by the Trial Court that the trial of this case is likely to be concluded within 9 months.

6. In the present facts and circumstances of this case and the submissions made above, this Court is not inclined to grant bail to the petitioner and, therefore, his bail application is hereby rejected again.

7. With this observation, the bail application stands rejected.
