2. The petitioner is apprehending his arrest in a case in connection with Aurangabad (Muffasil) P.S. Case No. 295 of 2024 dated 19.08.2024 registered for the offences punishable under Sections 126(2), 115(2), 109, 352, 351(2) read with Section 3(5) of B.N.S.

3. As per the prosecution case, when the informant along with his brothers was sitting near the door of his house, in the meantime, the petitioner along with the other co-accused persons having lathi, khanti in their hands, arrived there and assaulted them, as a result of which the informant and his brother sustained injuries.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. It is further submitted that the petitioner is the next door neighbour of the informant and the occurrence has taken place due to filling of soil in the adjacent land and the injuries sustained on both sides. The uncle of the petitioner has sustained grievous injury on right side nosal bone due to the assault made by the informant side. There is a case and counter case between both the parties. There is no specific allegation against the petitioner rather the allegation is general and omnibus in nature. The petitioner has no concern with the alleged offence. The petitioner has no criminal antecedent as stated at para 3 of the bail petition. The co-accused persons have already been granted anticipatory bail by a Co-ordinate Bench of this Court vide order dated 17.01.2025 passed in Cr. Misc. No. 79807 of 2024.

5. Learned A.P.P. for the State has vehemently opposed the prayer for anticipatory bail of the petitioner.

6. Considering the aforesaid facts and circumstances of the case, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on anticipatory bail on furnishing bail-bond of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like

7. The application stands allowed.
