04-01-2022 Heard learned counsel for the parties through video conferencing.

The petitioner seeks bail in Sabour P.S. Case No. 03 of 2020, registered for the offence under Sections 304(B), 120(B), 34 of the Indian Penal Code.

As per the prosecution case, this petitioner alongwith other in-laws members killed the daughter of the informant by administering her poison. Petitioner is husband of the deceased. It is submitted on behalf of petitioner that petitioner never demanded any dowry and deceased has committed suicide after consuming poison. It is further submitted that after consuming poison by deceased, the petitioner immediately took her to the doctor, where in course of treatment, she died. Petitioner is in custody since 02.01.2020.

No.46488 of 2021(3) dt.04-01-2022 2/2 However, learned A.P.P. for the State opposed the bail petition and submitted that petitioner is husband of the deceased and the deceased died in an unnatural circumstances at her matrimonial home within seven years of marriage. Considering the aforesaid facts and circumstances, I am not inclined to grant bail to the petitioner and same is, accordingly, rejected.
