1. Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 363, 366, 34 of the Indian Penal Code and Section 10 of POCSO Act.
3. Learned counsel for the petitioner submits that petitioner is a person with petitioner is a person with clean antecedent and is a young boy aged about 19 years. It is next submitted that similarly situated co-accused Pappu Kumar had approached this court seeking anticipatory bail by filing Cr. Misc. No.23402 of 2023, which was allowed by an order dated 14.07.2023. It is next submitted that while considering the case of Pappu Kumar, the court had considered the merits of the case and thereafter the privilege of anticipatory bail was granted to
Patna High Court CR. MISC. No.44406 of 2023(4) dt.17-05-2024 2/2 Pappu Kumar. It is next submitted that since the petitioner is also similarly situated like Pappu Kumar, as such, the privilege of anticipatory bail based on parity be granted to the petitioner.
4. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.
5. Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Choraut P.S. Case No.164/2022, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
