Petitioner and other four accused are named in the first information report on the accusation that they having entered into the house of the deceased started assaulting the informant's mother and when the informant's father came to her rescue he was too assaulted as a result of which he sustained head injury and died. The statement of mother of informant was recorded at Para40 of the case diary after death of the deceased and she disclosed that it was co-accused Ranjeet Sahani, who assaulted the deceased causing head injury and so far as this petitioner is concerned, the aforesaid witness has not named the petitioner.
