Petitioners apprehend their arrest in a case registered for the offence punishable under Section 302/ 34 of the Indian Penal Code.
As per the prosecution case, informant suspects that these petitioners along with other accused persons killed her husband in pre-planned manner while he was returning from his shop.
Learned counsel appearing for the petitioners submits that petitioners are innocent and have falsely been implicated in the case. Informant is not an eye witness of the occurrence and only on suspicion petitioners have been made accused in this case. Both parties are Gotias and land dispute is going on
Patna High Court CR. MISC. No.37464 of 2022(3) dt.19-12-2022 2/2 between them. The doctor during post mortem examination found no external or internal injury on the body of the deceased. At best it is a case of circumstantial evidence as the petitioners were seen fleeing away from the place of occurrence. Petitioners have got clean antecedent.
Learned counsel appearing for the State and the informant opposed the prayer for anticipatory bail and submitted that petitioners are named in the FIR and they along with other accused persons killed her husband in pre planned manner..
Considering the facts of the case and clean antecedent of the petitioners, let the petitioners, above named, in the event of their arrest/ surrender within a period of six weeks from today shall be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st class, Munger in connection with Dharhara PS case No. 03/ 2022, subject to conditions laid down u/s 438(2) of the Cr. P. C. (Prabhat Kumar Singh, J) BKS/- U T
