The petitioner is in judicial custody in connection with Nathnagar (Madhusudanpur) P.S. Case No. 444 of 2022 registered under Sections 307, 504, 506 and 427/34 of the Indian Penal Code and Section 25 (1-b)a, 26 and 27 of the Arms Act lodged on 28.06.2022 by the informant, Karu Sah. As per the prosecution story, the allegation is that the informant's daughter informed him that some one has enquired upon him, went to their shop, this petitioner and some unknown persons came, allegation is that this petitioner took out his pistol from the waist and fired and some particles of it entered into the stomach of the informant. They fled away. This led to

It is the case of the petitioner that the injury has been found to be simple in nature, he has remained in custody since 07.09.2022 (as stated in paragraph-11 of the petition). Learned APP opposes the prayer for bail stating that a bare perusal of the Annexure-3 would show that he has ten (10) criminal antecedent of almost of same nature and in the habit of opening fire.

Taking into account the kind of allegation that has come against the petitioner, for the present, this Court is not inclined to grant him privilege of bail which is accordingly rejected.
